The mission of the Mephisto Make-up Art School Hasso von Hugo is to train enthusiastic students to become professional young make-up artists and to make them successful. On our website we inform our customers about our offer and offer them the direct possibility to apply for a job at our institute. In addition, we regularly advertise open positions. For this reason, Mephisto Make-up Art School Hasso von Hugo offers its customers at various locations to conclude a so-called information contract. Mephisto Make-up Artist School Hasso von Hugo undertakes to provide information applicants regularly with further training material as well as general information. Four essential parts of the contract are particularly important: Firstly, Mephisto Make-up Art School Hasso von Hugo Mission is to train enthusiastic people to become professional top make-up artists and to provide them with information and product material. Secondly, the subject matter of the respective information contract is determined on the one hand at the time of the concrete order and additionally by these General Information Conditions (AIB). Thirdly, the information purchaser can terminate the contract at any time, without giving reasons and informally. Fourthly, this information service is free of charge.

§ 1 Subject matter of the contract, obligations of Mephisto Make-up Art School Hasso von Hugo

1. The object of the contract is that Mephisto Make-up Art School Hasso von Hugo provides the information requester with information about all conceivable contact channels (letter post, SMS, e-mail, social networks and comparable contact channels). Basically, the topics of this information are determined by the concrete information contract (product and/or service description). In any case, however, this can be information from the following subject areas: Make-up, training details, tips and information about make-up, further education and training material, offers and current events, dates, general information about the company, etc.

(2) Mephisto Make-up Art School Hasso von Hugo is, with regard to paragraph 1, among other things also obliged to deliver the contractual information also in social networks and comparable contact channels. For this purpose, Mephisto Make-up Art School Hasso von Hugo is obliged, as far as technically possible, to upload the email address to a custom audience on facebook or a „similar audience“ on Goolge and, as far as possible, to deliver information there as well. This applies subject to the provision in paragraph 3.

(3) Mephisto Make-up Art School Hasso von Hugo is also obligated to exclude the information requester, if he or she is already registered for a webinar, from advertising for potential new webinar or training course participants on facebook or Google within the framework of technical possibilities. For this purpose, Klick-Tipp must upload the e-mail address to a custom audience on facebook or to a „similar audience“ on Goolge. With advertisements for potential new training course participants the information orderers are excluded.

(4) A claim to the fact that all these topics are covered does not exist.

(5) Furthermore, Mephisto Make-up Art School Hasso von Hugo does not owe any consultation or the checking of this information for accuracy of content, but only the provision of the information.

§ 2 Conclusion of contract

(1) The information contract is concluded when the person ordering information requests a service from the Mephisto Make-up Art School Hasso von Hugo either digitally, in writing or in another unambiguous (including implied) form, whose product or service description refers to the conclusion of an information contract.

(2) These General Conditions of Information shall also become part of the contract.

§ 3 Free of charge

The information requester does not have to pay money for the relationship of the information.

§ 4 Termination of the information contract

Either party may terminate the contract at any time, without giving reasons and without notice.

§ 5 Liability

1. Mephisto Make-up Art School Hasso von Hugo is only liable without limitation for intent and gross negligence.

(2) Mephisto Make-up Art School Hasso von Hugo is only liable for simple negligence – except in cases of injury to life, body or health – if essential contractual obligations (cardinal obligations) are violated.

(3) Liability for indirect and unforeseeable damages, loss of production and use, loss of profit, lack of savings and financial losses due to third-party claims is excluded in the case of simple negligence – except in the case of injury to life, body or health.

(4) Any further liability other than that of this contract is excluded – regardless of the legal nature of the asserted claim.
However, the aforementioned limitations or exclusions of liability do not apply to any mandatory statutory liability without fault (e.g. under the German Product Liability Act) or liability under a guarantee without fault.

(5) Insofar as liability is excluded or limited in accordance with paragraphs 2 and 3, this also applies to the personal liability of the employees, workers, representatives, organs and vicarious agents of Mephisto Make-up Art School Hasso von Hugo.

§ 6 Reservation of right of modification

Mephisto Make-up Art School Hasso von Hugo has the right to unilaterally change these AIB insofar as this is necessary to eliminate subsequently arising equivalence disorders or to adapt to changed legal or technical conditions or to expand the information offer or the information channels. The person ordering information will be informed of any change by sending a notification of the content of the changed regulations to the last known e-mail address. The change will become part of the contract if the information purchaser does not object to the inclusion in the contractual relationship with Mephisto Make-up Art School Hasso von Hugo in written or text form within six weeks of receipt of the change notification.
